A Woman’s Malicious Accusation Leads to Imprisonment and Harsher Legal Repercussions

In a shocking turn of events, a woman in her 30s has been sentenced to prison after falsely accusing her biological father, who generously funded her education overseas, of being a rapist when he refused to continue providing her with financial support.

On the 1st of the month, as detailed by legal authorities, Judge Choi Chi-bong, presiding over the Criminal Division 1 at the Namyangju Branch of the Uijeongbu District Court, delivered a verdict against the woman, known only as A, condemning her to a 10-month imprisonment. The charges against her include defamation, disruption of business activities, and slander.

The daughter, despite having received substantial backing from her father for her studies abroad, resorted to vilifying him as a sexual assailant once he declined her financial demands. This narrative unfolds against a backdrop unrelated to the case. [Image Credit: Pixabay@Engin_Akyurt]

The legal proceedings revealed that A engaged in a defamation campaign, posting slanderous content on an online forum on 11 separate occasions between May and June of the previous year. Under the guise of seeking help as a "victim of familial sexual violence," she aimed to tarnish her father's reputation.

Her posts included fabricated statements that painted a grim picture of ongoing sexual abuse since the age of four, not only implicating her father but also alleging domestic and sexual violence against her mother. She claimed the issue was resolved with a payout of 30 million won and called for harsh punishment.

In addition to these grave accusations, A publicly disclosed her father's name and business details, which reportedly led to significant operational challenges for his business.


 


In a further attempt to discredit him, she accused her father of remarrying a woman, C, whom he allegedly had an affair with, making six defamatory online posts on the subject.

In a bid for justice—or perhaps revenge—in February 2021, A initiated a lawsuit against her father at the Incheon District Court, seeking compensation for alleged sexual assault. However, the court found her claims baseless as she failed to substantiate them with any evidence of wrongdoing.

During the criminal proceedings, A maintained the veracity of her allegations. Nevertheless, the court dismissed her assertions, referencing the lawsuit's outcome and underscoring the absence of credible evidence or circumstances to support her claims of habitual sexual assault by her father.

The court rationalized that A's allegations were likely false, especially given that her father had financially supported her studies abroad and beyond, and the accusation surfaced soon after he denied her a hefty sum for a business venture she intended to start—a cafe.


In delivering its verdict, the court highlighted that A's actions stemmed from a disgruntled response to being denied further financial aid. It noted the irreparable damage inflicted on the victims' reputations by her false claims.


Explaining the rationale behind the sentencing, the court articulated concerns over A's potential for reoffending, as evidenced by her continued dissemination of similar accusations post-crime. Furthermore, the victims’ strong plea for a severe penalty influenced the comprehensive evaluation of these factors.
